Terms and conditions of use

These Terms of Service ("Terms") govern your use of SimchaZall.com. By accessing or using the Platform, you agree to these Terms.

1. Use of the Platform

  • SimchaZall.com (the "Platform") connects people planning events ("Customers") with venues and vendors ("Vendors").
  • You agree to provide accurate information and to use the Platform only for lawful purposes.

2. Vendor Listings and Profiles

  • Each Vendor is responsible for the accuracy of its profile, pricing, availability and listed services.
  • Each Vendor agrees to fulfill the reservations it accepts professionally and as described.

3. Reservations and Payments

  • Customers may reserve services through the Platform.
  • A flat reservation fee, based on the reservation total, is charged when a reservation is confirmed.
  • The remaining balance is paid by the Customer directly to the Vendor, under the Vendor's payment terms.
  • Each Vendor is solely responsible for managing and collecting its remaining balance.
  • SimchaZall.com does not process or hold any payment of the remaining balance.

4. Fees

  • Vendors accept SimchaZall.com's reservation fee: a flat fee based on the reservation total, according to the fee schedule SimchaZall.com publishes to Vendors. No fee is charged unless a reservation is confirmed.
  • The reservation fee is paid by the Customer and counts toward the reservation total, so the balance the Customer owes the Vendor is reduced by the amount of the fee.

5. Cancellations and Disputes

  • Cancellations and disputes are handled directly between the Customer and the Vendor.
  • SimchaZall.com's liability for any refund or dispute is limited to the reservation fee.

6. Termination

  • SimchaZall.com may suspend or terminate any account that violates these Terms or misuses the Platform.

7. Limitation of Liability

  • The Platform is provided "as is."
  • SimchaZall.com is not responsible for Vendor performance, event outcomes, or damages resulting from use of the Platform.

8. Changes to These Terms

  • SimchaZall.com may update these Terms at any time.
  • Continued use of the Platform after an update means you accept the updated Terms.
